1. Definitions
“Company” = Europa Xpress Ltd. “Customer” = contracting party. “Consignment” = goods carried under one contract. “Dangerous Goods” = items restricted by law/ADR/IATA/IMDG.
2. Application
These Terms apply to all contracts unless agreed otherwise in writing.
3. Services
UK & EU temperature-controlled courier (ambient, chilled, frozen). Vehicles ATP compliant, tracked, temp-monitored.4. Customer’s Duties
Goods must be described, packaged, labelled. No prohibited/dangerous goods. Customer warrants authority to ship.
5. Liability
No liability for indirect/consequential loss. Limited to £50,000 GIT cover per vehicle or value of goods (whichever lower). Claims must be in writing within 7 days.
6. Insurance
GIT up to £50,000. Extra cover may be arranged at Customer’s cost.
7. Delivery
Times are estimates only. No liability for delays outside control (traffic, weather, strikes, customs, breakdown). Waiting: 30 mins free, then £25/hr.
8. Payment
Terms: 30 days from invoice. Interest may be charged under Late Payment of Commercial Debts Act 1998.
9. Prohibited Goods
We will not carry: firearms/weapons; explosives, flammables, chemicals, paints, fireworks; cash, jewellery, precious metals/art; live animals/plants; illegal substances; passports/ID/cards; goods banned by law.
10. Dangerous Goods
ADR/IATA/IMDG goods carried only if pre-agreed in writing, declared, packaged, and documented.
11. Termination
We may suspend/refuse carriage if Customer breaches Terms, payment is overdue, or goods are unsafe/illegal.
12. Governing Law
English law applies. Disputes subject to exclusive jurisdiction of England, Scotland & Wales courts.
